Terms of use of the Cytavision Service through an application (TV App) for smart TVs

1. General

The present terms govern the use of the Cytavision service (hereinafter the “Service”) via a smart TV application (TV App). The Cytavision Service via the TV App, provided by Cyta, enables Cytavision Subscribers to watch entertainment content, "Cytavision content", through an application on Smart TVs and Android TV devices, provided that an internet or mobile network connection (4G or 5G) is available.

2. Access Method

The Cytavision Service via a smart TV application (hereinafter the “TV App”) is offered to existing or new residential Cytavision Subscribers (hereinafter the “Subscriber”), as a means of access to the core Cytavision Service. The content made available through the Service is determined by Cyta and communicated to the Subscriber via the website TV | Cyta.

The TV App is available in three versions depending on the device manufacturer:

Android Application: The Cytavision TV App is supported on smart TV models and Android TVs devices released within the last five (5) “Device model years” and is available on the Google Play Store.

Samsung Application: The Cytavision TV App is supported on Samsung smart TV models released within the last five (5) “TV model years” and is available on the Samsung App Store.

LG Application: The Cytavision TV App is supported on LG smart TV models released within the last five (5) TV model years, of FHD or UHD type, and is available on the LG Content Store.

Cyta does not guarantee the operation of the Service on older TV models and Android TV devices beyond the last five (5) years or on devices that do not meet the technical specifications published on its website.

Cytavision TV Box: The Cytavision TV App is also supported via the Cytavision TV Box, which constitutes managed equipment owned by Cyta. Each Subscriber may, if they so wish, obtain one (1) Cytavision TV Box at no monthly charge with the core Service package, with a maximum of up to three (3) devices, depending on the number of additional viewing options included in their subscription. In the event of termination of the core Service package and/or any additional viewing options, the equipment must be returned to Cyta.

Through the Cytavision TV Box, which is based on an Android TV platform and constitutes managed terminal equipment of the Service, Cyta may perform remote actions necessary to ensure the proper operation, security, compliance, and technical support of the Cytavision Service.

Such actions may include, indicatively and not exhaustively, software and firmware upgrades (including updates to the Android TV operating system), management and configuration of system settings, installation, updates, deactivation and/or removal of applications (including applications of Cyta, Google and/or third-party providers), device restart, as well as the collection and processing of technical information related to usage, performance, connectivity, service availability, and the operational status of the device.

It is clarified that device and application management policies may be applied, in accordance with the requirements of the Android TV platform and relevant providers, for purposes of security, compliance, and proper provision of the Service.

The above actions are carried out solely for the purposes of management, maintenance, technical support, security, compliance, and improvement of the Service and do not include access to the content viewed by the user, unless required for the diagnosis and resolution of a technical issue and subject to the user’s consent.

The processing of any data is carried out in accordance with applicable legislation, the applicable policies of the Android TV/Google platform, and the applicable Privacy Policy | Cyta.

The Service through TV App is governed by Cyta’s “General Agreement for the Provision of Electronic Communications Services” and the “Special Terms” of the Cytavision Service. More information can be found on Cyta’s website at General Agreement and Services Special Terms | Cyta.

3. Subscription Packages and Prices

1. The Service through TV App is provided through the basic home packages Value TV Pack, Variety TV Pack, and the Cyprus Football Pack.
2. The Adult Pack (adult channels pack, Hustler Blue, VOD movies) is not available through the Cytavision TV App.

Cyta reserves the right to revise the fees for its services in accordance with Cyta’s “General Agreement for the Provision of Electronic Communications Services” and the “Special Terms” of the Cytavision Service.

3. Trial Pack

Every new customer of the Cytavision subscription service can activate the Trial Package and test the Service. The Trial Package is provided for a limited period of three (3) months free of charge. At the end of the three (3) months, if the customer does not request the termination of the Trial Package, they will automatically be transferred to the Value TV Pack of the Service and will be charged with the corresponding monthly fee of the package. The Subscriber has the right to upgrade from the Trial Pack to one of Cytavision's basic packages (Value TV Pack, Variety TV Pack and Cyprus Football Pack). In this case, the Subscriber will be charged proportionally for the monthly fee of the new package from the date of its activation, as well as other fees for any additional packages or purchases.

The activation of the Trial Pack shall be permitted only once within a period of 12 months per customer.

4. Operation of the Cytavision TV App

The Service via TV App and the content transmitted via the service, are intended exclusively for private, non-commercial use. During the subscription to the Service via TV App, the Subscriber is granted a limited, non- exclusive and non-transferrable right to access and view the content. Public performance or commercial use is prohibited.

Viewing via TV App is possible within the government-controlled areas of the Republic of Cyprus and in countries of the European Union, where such content is licensed in accordance with European Regulation (EU) 2017/1128.

Use by minors is permitted only with parental or guardian consent.

With the basic packages of the Service (Value TV Pack, Variety TV Pack and Cyprus Football Pack) it is possible to register one (1) TV device and three (3) mobile devices. Only two (2) devices will be able to transmit content simultaneously, regardless of device type (one (1) TV device and one (1) mobile device.

For viewing on more than one (1) TV device, the "Additional Viewing Add-On Pack " is available. The maximum number of simultaneous TV viewings through the Service is three (3). In the event that the Subscriber has purchased the "Additional Viewing Add-On Pack ", the television devices in his/her premises will work simultaneously as long as they are connected to the same fixed broadband network.

The content and the functions of the Cytavision Service via TV App shall be updated on a regular basis and can be found on the website TV | Cyta.

The Service via TV App allows the transmission of content on devices supporting the Cytavision Service software. Such software as well as the functionalities and the capabilities of the Service through TV App may vary depending on the appliance. Updated information can be found on the website: TV | Cyta.

Minimum required download speed for SD/HD content is 10Mbps and for UHD content is 30Mbps.

Viewing quality of Cytavision content via TV App may vary from device to device and may be affected by factors such as the Subscriber's location, available bandwidth, internet or mobile network connection speed and device capabilities. The Subscriber is responsible for all internet or mobile network access charges. The Subscriber should contact his provider for information on possible internet or mobile data usage charges.

The Subscriber agrees to receive automatic updates of the application. The operation of the Service may be affected by changes or upgrades made by third-party providers (e.g. device manufacturers or operating system providers), for which Cyta has no responsibility.

The Subscriber agrees not to archive, reproduce, distribute, modify, display, perform, publish, authorise, create derivative content, offer for sale or use (except as expressly permitted under these Terms of Use) any content or information contained or received from the Cytavision Service TV App.

In addition, the Subscriber agrees not to bypass, remove, modify, deactivate, downgrade or suspend any features put in place to protect the content of the Service via TV App, not to use robots, spider, data export tools or other automated means of accessing the Service via TV App, not to decipher, decompile or disassemble any of the software or other products or processes capable of providing access to the Service via TV App, not to incorporate passwords or products and not to alter the content of Service via TV App in any way or to mine, gather or export data. Furthermore, the Subscriber agrees not to download/upload publish, send via e-mail or otherwise send or transmit material designed to interrupt, destroy or restrict the functionality of any computer software, telecommunications material or hardware related to the Service via TV App, including software viruses or other computer code, files or programmes. In case of violation of the present Terms of Use or participation in the illegal or fraudulent use of the Service via TV App, Cyta may disconnect or restrict the use of the service and take all necessary legal measures.

5. Passwords to access Cytavision application via TV App

The Username and the temporary password which will be used for access of the Subscriber to the Service via TV App, shall be provided to the Subscriber upon the activation of the Service.

Upon the Subscriber using the temporary password during his first access to the Service, he/she will be asked to change to a new password. The Subscriber must choose a password that provides him/her with maximum security and protects him from interceptions.

The password is combined with the username (username) to access the Cytavision TV App Service.

In order to keep control of the account and avoid allowing others to access the account, the Subscriber should monitor all devices that support the Service through the TV App and which are used to access the service, and never reveal his/her username and password.

The Subscriber is responsible to monitor the use of the Parental Pin and the Purchase Pin as these are defined in Cyta’s “General Agreement for the Provision of ElectronicCommunication Services” and the “Special Terms” of the Cytavision Service: General Agreement and Services Special Terms | Cyta.

The Subscriber is responsible for updating and maintaining the accuracy of information provided to Cyta.

Cyta reserves its right to disconnect or suspend the Service in order to protect the Subscriber, the Service or its partners against any fraudulent activities.

6. Charges and Termination

6.1 The subscription fees for the “Value TV Pack” and “Variety TV Pack” are calculated and charged on a daily basis upon activation of the Service. During the month in which an upgrade, downgrade or termination takes place, the subscription fees are also charged on a daily basis, according to the number of days each package was used.

6.2 The subscription for the “Cyprus Football” package and the “additional sports content packages” is calculated and charged on a daily basis upon the activation of the service. During the month of termination of the service or deactivation of the package, the subscription is also charged on a daily basis. In the event that the termination or deactivation occurs within the same month as the activation, an early termination fee applies for the “Cyprus Football” package and the “International Sports” package, in accordance with the applicable charges in force, as published on Cyta’s official website at TV | Cyta.

6.3 In the event of termination of the core Service package and/or any additional viewing options, the Subscriber is required to promptly return the Cytavision TV Box equipment to Cyta in good condition. In case of failure to return the equipment or return in an unacceptable condition, Cyta reserves the right to impose a relevant one-off charge, in accordance with the applicable charges in force, as published on Cyta’s official website at TV | Cyta.

7. Limitation of Liability

7.1 The Service is provided “as is”, and Cyta does not guarantee the continuous provision thereof and shall not be liable for occasional access failure and/or unsatisfactory quality of signal and image/sound, for occasional shortcomings in the function of the user interface. The above shall be without prejudice to the Subscriber's rights arising under the applicable legislation in force from time to time.

7.2 Cyta is not responsible for the quality, adequacy and security of third-party networks used and/or to be used to provide the Cytavision TV App Service, as well as for the shortcomings and/or unsatisfactory reception of services due to the Subscriber's device or equipment or any inappropriate use and/or misuse of the equipment or any insufficient or inappropriate infrastructure of the Subscriber on the premises (including cabling) and does not bear any responsibility to replace, maintain, upgrade or repair either the equipment or the infrastructure of the Subscriber.

7.3 Cyta shall not be liable for any permanent or temporary weaknesses of the subscriber’s internet.

7.4 The availability of the App may be affected by third-party platforms or app stores (e.g. Samsung, Google, LG), which operate outside Cyta’s control.

9. Termination

Cyta reserves its right to terminate the Service immediately without prior notice in the event that the Subscriber is in breach of these Terms of Use.

The Subscriber may terminate Cyta’s Cytavision Service by visiting t any Cyta shop,by contacting the Call Center on 132 or 150, or through their Business Account Manager.

10. Personal Data

Cyta processes the Subscriber’s personal data for the purpose of providing the Service, its support and billing. Personal data shall be retained for the duration of the Subscriber’s contract.

Certain data relating to the application, such as metadata and usage information, will be processed by the application provider, Samsung Korea, in accordance with its terms and Privacy Policy (https://seller.samsungapps.com/tv/contract/tnc).

Cyta will send the Subscriber information regarding the Service (e.g. password changes, confirmation messages, notifications) via text message (SMS) to the mobile phone or via electronic mail (email) to the email address provided to Cyta for digital assistance.

11. Miscellaneous

To complete the registration process and to activate the Service, the Subscriber must accept these Terms of Use and provide a contact number (mobile phone) to Cyta or an email address for digital assistance.

Cyta reserves the right to amend these Terms of Use, subject to prior notification of Subscribers, in accordance with the applicable legislation and regulatory framework in force from time to time.

Cyta reserves its right to amend these Terms of Use. Any amendments shall be published on the website: Cytavision TV App | Cyta.
