Cyta Website General Terms of Use

1.1 Users may be required to register to some of the Services by filling the registration form found on the Site. In such a case they shall be required to give certain information such as name, address, or other information. Users are obliged to provide true, accurate, current and complete information about themselves and they are obliged to maintain and update such information.

1.2 If Cyta (which expression includes its officers and employees) has reasonable grounds to suspect that the information given is false, inaccurate, not current or incomplete, they will have the right not to create or to terminate the user’s account or deny future use, without notification.

1.3 Users will be given or shall be required to select a password and/or user name, during the registration process. Users will be entirely responsible for maintaining the confidentiality of their password and will be responsible for all activities taking place under this password. Passwords are not transferable and cannot be traded. Cyta is not and shall not be responsible or liable for any unauthorized access to the Services or unauthorized use of the Services or unauthorized use of the password.

1.4 In case of unauthorized use of the user’s password and/or user name, users are obliged to notify Cyta immediately.

2.1 Users shall be solely responsible for all information, data, text, messages or other material transmitted through the Services. Cyta shall not monitor the content transmitted through the Services and cannot guarantee the accuracy, integrity or quality of the content. Cyta shall not be liable in any way for any loss or damage of any kind incurred as a result of the content transmitted via the Services.

2.2 Users shall not use the Services in order to:

a) transmit and/or distribute in any way any content that is unlawful, harmful, threatening, abusive, tortuous, harassing, defamatory, libellous, fraudulent, pornographic, indecent, invasive of another’s privacy or otherwise inappropriate.
b) discriminate, degrade or offend an individual or group of individuals on the basis of religion, sex, race, nationality, age or disability.
c) harm minors in any way.
d) transmit any content that they have no right to transmit, including but not limited to, proprietary and confidential information.
e) transmit and/or distribute in any way, content that infringes any patent, copyright, trademark, service mark, trade secret or other proprietary rights of any person.
f) transmit and/or distribute any unsolicited or unauthorised material.
g) collect, use, store or monitor personal data.
h) broadcast, advertise or offer to sell or promote any goods or services without Cyta’s consent.
i) offend the Constitution or any Law or International Treaty applicable in the Republic of Cyprus.

2.3 Cyta reserves the right to block or suspend user’s access to the Services in case of breach of this clause 2.

Users shall indemnify and hold harmless, both during the continuance in force of this Agreement as well as after its termination, Cyta, its affiliates, shareholders, officers, directors, employees, agents, successors and assigns, against all claims, actions or causes of actions, losses, liabilities, cost and expenses, including legal fees, raised by or incurred to third parties, arising out of any breach of the present Terms and Conditions or the use of the Services.

Cyta shall take all reasonable steps to protect the privacy of its users. All information and data given during registration shall be protected in accordance to the Cyta's Privacy Policy.

5.1 Cyta reserves the right at any time without assigning any reason to:

a) update, modify or discontinue temporarily or permanently the Services, or terminate any user’s account, (including password and user name) or bar use of, or deny or suspend access to the Service.

b) remove any content or material uploaded or stored to the Services, for any reason whatsoever including, but not limited to breach of the present terms. Users will be notified in case of amendment of the present Terms and Conditions.

5.2 Cyta may terminate any user account in case of non use of the Services for a reasonable period of time.

6.1 Cyta shall not be liable for any direct, indirect, punitive, incidental, special, consequential or exemplary damages for loss of profits, goodwill, or other losses resulting from:

a) the use or inability to use the Services.
b) any goods, data, information or services obtained or accessed via the Services.
c) unauthorised access or alteration of data.
d) claims arising from use of the software.
e) infringement of any rights of any person of whatever nature effected or attempted through the Services.
f) discontinuance of the Services or disconnection of the uses.
g) payment or misdirected payments.

6.2 Cyta shall not be liable for any claims resulting from the automatic, intermediate and temporary storage of information and data for the sole purpose of making more efficient the onward transmission of such information to the recipient of a requested Service or for the partial or total loss or misdirection or non transmission of the same.

6.3 Users are solely responsible for all information, data, text messages or other material stored or transmitted via the service. Cyta shall not monitor the content stored or transmitted via the Services and do not guarantee accuracy, integrity or quality of any content. Cyta shall not be liable in any way for any loss or damage of any kind incurred as a result of the content stored or transmitted or accessed via the Services.

6.4 Cyta is not and shall not be liable for any content, advertisement, transactions, products, services other material provided on the Services by third parties or any dealings or claim connected to, or resulting from the above.

6.5 Cyta makes no warranties of any kind whether express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose which are hereby expressly disclaimed. In particular, without limitation, Cyta does not warrant that the Services will be uninterrupted, timely, secure or error free or that the Services will be available at any particular time or location.

6.6 Cyta shall not be responsible for any defamation of character or goods or services for any infringement of intellectual property rights or trade names or trademarks or patents or any contempt of Court or infringement of the rights to privacy of any person or any breach of contract or civil wrong or tort or other violation or infringement of right or offence committed or attempted through the Services.

This Site, the Services and the software connected with the Services and all material or content contains information is protected by copyright, trademarks, service marks, patents or other proprietary rights. Users may not copy, reproduce, distribute, commercially exploit or create derivative works from the above without expressly being authorised to do so in writing by Cyta or the publisher of such content.

These Terms and Conditions shall be governed in all respects by the laws of the Republic of Cyprus.
