The Contests are conducted by Alpha TV Cyprus on behalf of Cyta (the Organiser). The Gifts are granted either by Cyta or by its associates based on the relevant information of the respective contest.

The present Terms and Conditions apply exclusively to competitions conducted in collaboration with Cyta's partner, Alpha TV Cyprus, through the Megaphone TV platform provided by Play Megaphone Inc.

2.1  Without prejudice to what is defined in Term 2.2. below, right to participate in the Contest resides only with natural persons who are permanent residents of Cyprus and have attained the age of 18 years (hereinafter the “Participant(s)”).

Cyta reserves the right to request the identification of the Participants to confirm their eligibility to participate and for purposes of awarding the Gifts.

2.2  The following are entitled to claim the Gift:

(a)   all persons who are not Cyta or Alpha TV personnel (employees, hourly rate personnel and employees of subsidiary companies) and their retired employees.
(b)   all persons who are not sports journalists cooperating with Cytavision or Alpha TV.
(c)   all persons who are not first-degree relatives or spouses of Cyta or Alpha TV personnel (as defined in Terms 2.2 (a) and (b) above).

2.3  Disqualification may occur at any stage of the Contest even during the stage of delivery of the Gift.

2.4  The Contest shall be carried out on any and/or all days of the week at a specific time and duration (hereinafter “Contest Duration”) that will be determined at the Organiser’s discretion and will be announced either in the respective episode of any television or online show (Podcast) and/or through the website and/or Cytavision’s social media accounts.

3.1  Participants can enter the website through which the Contest is carried out in two ways. Either (a) by scanning with the camera of their mobile device (mobile phone, tablet, etc.) the relevant QR code which will be displayed  on the screen during the presentation of the Contest as described in point 2.4 and will redirect them to the website “funzone.cyta.com.cy” (hereinafter the “Website”) leading to the Megaphone TV Platform provided by the company Play Megaphone Inc. (the “Platform”), where the Terms and Conditions are posted, or (b) by entering the URL “funzone.cyta.com.cy”  directly into a browser to access the webpage.

After Participants fill in their First and Last Name as well as their telephone number, read and accept the Terms and Conditions of the contest and the Platform, they should select and submit their answer(s) to the question(s) of each Contest. Once the answer(s) is/are submitted, participation in the contest is concluded (hereinafter “Participation”). For the avoidance of doubt, scanning, registration and participation in the Contest only apply during the airing of any Shows that will be broadcast during the Contest duration, and not during any potential re-runs of those Shows aired during or after the Contest Duration.

3.2  Any other method of participation is not acceptable.

3.3  Each natural person is entitled to one participation in each contest.

3.4  Participants acknowledge and unconditionally accept that the operation of the Platform and the Website and consequently their access and participation in the Contest may be affected by or temporarily interrupted due to network and/or the Platform and/or Webpage issues. Participation to the Contest may be subject to changes or interruptions that are entirely dependent on the capabilities of the technology not only of this Platform and/or Webpage but also the underlying technology on which it is based and that are beyond the control and responsibility of the Organiser who bears no responsibility for the aforementioned reasons.

3.5  Participation assumes that interested parties have access to the internet using their own technical means. The Organiser, its associates, the Platform and Alpha TV do not assume any obligations regarding the safeguarding, facilitating access to internet sites or granting any facilities to interested parties. Access to the Platform and the Website is permitted only under the conditions of operation for this Platform and Website, own servers and technical and other terms and conditions of the Platform and/or Website. Furthermore, the Organiser, its associates, the Platform and Alpha TV bear no responsibility for any difficulties experienced  by participant users due to the above reasons.

4.1  The Contest is a quiz consisting of one or more general interest questions as presented in each contest.

4.2  During each Contest, the participation and winner identification procedures, duration and Gift as described in Term 5 will be announced so that Participants are informed in order to either scan the QR code that will be shown on the screen and/or through Cytavision social media accounts or to visit the Webpage as described in paragraph 3.1 above, to participate to the Contest.

4.3  Participants will have limited time available to answer the question(s).

4.4  If it is proven that a Participant has been declared a Winner in violation of the Rules and/or by fraudulent means, the Gift shall not be awarded to them or they shall automatically forfeit any right to possess it.

In the event of invalid Participation in the Contest or if the winner does not respond within the specified timeframe, the Gift will be awarded to the next valid Participant or Runner-up. For each prize, one (1) winner and five (5) runners-up will be selected in ranked order, through the same selection process.

5.1  Winners of each Contest will receive a Gift of a specific value, as determined by the Organiser from time to time and announced in the relevant Contest announcement.

5.2  The Gift does not include, without limitation, any costs related to the Gift.

5.3  The Organiser shows reasonable diligence to ensure that the Gift corresponds to the description provided in the relevant Contest announcement. The Organiser reserves the right to modify or substitute the Gift with an alternative of equal value.

5.4  The Gift is personal and specific, it is not transferable or exchangeable for money, services or products, it cannot be assigned to relatives or third parties, nor can it be substituted or redeemed.

5.5  To award the Gift, the Organiser will verify compliance with all terms and conditions for valid participation. Cyta reserves the right to request the Winner to provide an identity card or passport for verification of their personal details. Such verification may take place during the delivery of the Gift.

5.6  The Organiser assumes no responsibility, under any circumstances for any possible direct or indirect or associated damages, costs and expenses resulting from discontinuation, malfunction, delay, poor performance or any defect of the Gift that will be delivered. The Organiser disclaims any liability, penal or civil, towards any winner or third party for any accident that may occur and/or damage and/or injury or material losses incurred during the use of the gifts or from any other cause.

6.1  Once the Contest Duration is concluded, the Organiser will contact the Winner as soon as possible and notify him/her about the method of receiving his/her Gift. In case there is no response or acceptance of the Gift within 24 hours of contacting the Winner, Cyta reserves the right to award the Gift to the runner-up.

6.2  The deadline for receipt of the Gift shall be jointly set through consultation between Cyta and the Winner.

6.3  The Winner may receive the Gift from Cyta’s offices or from a Cyta shop of the Winner’s choice, upon identification by showing his/her identity card or passport.

Submission of incomplete, incorrect or untruthful personal details by Participants and/or the Winner gives the Organiser the right to annul their Participation in the Contest.

It is explicitly stated that, following the conclusion of the Contest, Participation will no longer be possible. Any participation attempted after the end of the Contest will be automatically considered null and void and will not bind the Organiser.

8.1  Unless otherwise provided by applicable legislation, Alpha TV, the Organiser and its associates bear no responsibility for compensating the Winner for any loss, damage, injury or any other harm that may result from the redemption and/or use of the Gift.

8.2  When using the Gift, the Organiser may use services provided by third parties. The Organiser is not responsible for any wrongful or incomplete provision of services by third parties nor for any damage or injury to anyone during the use of the Gift. The Organiser neither promises nor guarantees the performance of the contractual or other obligations of any third party in relation to the Gift.

9.1 The Personal Data entered by the Participants upon use of the Platform and/or Webpage, shall be processed after the Participants have submitted a relevant consent by Cyta, Alpha TV and the Platform provider, Play Megaphone Inc, USA for the purpose of carrying out the Contest, Gift reception, optimizing the Contest process and for safeguarding the transparency of the Contest procedure according to Cyta’s (Privacy Policy | Cyta) and the Play Megaphone’s Inc (Privacy Policy - Megaphone TV) Privacy Policies, exclusively for the above-mentioned purpose in accordance with the instructions of the Organiser and the provisions of Cypriot and European legislation regarding the protection of personal data. Adequate safeguards in relation to processing personal data are provided and/or relevant technical and organizational measures are implemented.

9.2  The Organiser and Alpha TV shall process the personal data of the Winner to ensure compliance with these Terms and Conditions, announce the Winner’s name and contact the Winner to arrange the delivery and receipt of the Gift, subject to a relevant contract. The personal data of the other Participants shall be processed by Alpha TV for enhancing the functioning of the Contest purposes.

9.3  The Winner and Participants have the right to submit a request to Cyta (dpo@cyta.com.cy) and to the Platform provider (privacy@megaphonetv.com) for access, correction, erasure of the personal data or limitation of the processing of their personal data. They also have the right to object to the processing as well as the right to data portability.

9.4  The personal data of the Winner and Participants shall be deleted within 2 months from the conclusion of each Contest.

9.5  Cyta reserves the right to promote the lucky winners (first and last names and photograph and/or video) through mass media and social media, as well as to use any relevant information for advertising purposes.

9.6  The first and last names and/or the photos/videos of the winning subscribers shall be broadcast/ displayed with a relevant notice on Cytavision’s TV or online shows, webpages as well as in mass media and social media.

10.1  If any provision of these Terms and Conditions is held by a Court or other competent authority to be invalid or unenforceable in whole or in part, the validity of other provisions and the remainder of the affected provision shall not be affected.

10.2  If it is determined that any Participant has infringed these Terms and Conditions, Alpha TV and the Organiser may, at their absolute discretion, disqualify that Participant from the Contest.

10.3  The Organiser reserves the right to modify and/or withdraw the Contest and/or change the dates for the Contest and/or any other term at any time and without notification. The Organiser may also interrupt or cancel without prior notification due to natural causes or force majeure or any other reason. In such a case, the Organiser bears no responsibility towards the Participants. Additionally, in the event of Contest annulment, the Participants shall have no rights, claim and demands against the Organiser, nor the right to demand the continuation of the Contest or any compensation due to any changes.

10.4  These Terms and Conditions are governed by Cypriot Law and any dispute relating to the Contest falls under the exclusive jurisdiction of the Cyprus Courts.
