Terms of Use: CytavisionGo as an additional service to the basic service of Cytavision via the fixed broadband network and/or through Cytavision TV App

1. General

  • The present Terms of Use govern the use of the CytavisionGo service. CytavisionGo is a personalised service provided by Cyta (Cytavision) which enables the viewing of content on the go (movies, TV channels and sports events transmitted via online streaming or a mobile network e.g. the 4G mobile network), on computers or other Android and iOS devices (tablets and smartphones), within or outside the Subscriber’s place of permanent residence in the European Union (EU), in accordance with European Regulation (EU) 2017/1128 on cross-border portability of online content, and provides the capabilities and functions of the CytavisionGo service as described on the website https://www.cyta.com.cy/cytavision-go.
  • To access CytavisionGo, the Subscriber must have a connection to the Internet or the mobile network.

2. Access method

  • CytavisionGo is provided to an existing customer (“The Subscriber”) as an additional service to the Cytavision service (provided via Cyta’s fixed broadband network and/or through Cytavision TV App)
  • The content transmitted via CytavisionGo is determined by Cyta, and the Subscriber can be informed about the content at Cyta’s website at: www.cyta.com.cy.
  • CytavisionGo allows the Subscriber to view content through its apps available from the App Store and Google Play and from www.ott.cytavision.com.cy.
  • CytavisionGo provides the Subscriber with a current contract the ability to view content of the basic package to which he/she has subscribed via the fixed broadband network.
  • Cyta determines the content available through CytavisionGo from time to time and publishes this information online at www.cyta.com.cy/tv.
  • Cytavision via the fixed broadband network and/or through Cytavision TV App is governed by Cyta’s General Agreement for the Provision of Electronic Communications and the Cytavision Special Terms & Conditions. For more information, visit https://www.cyta.com.cy/general-agreement.

3. Service operation

  • CytavisionGo and the content transmitted via the service are intended exclusively for the Subscriber’s personal use and not for any commercial use. A subscription to CytavisionGo provides a limited, non-exclusive and non-transferable right to access and view CytavisionGo. The public viewing of the service’s content is not permitted.
  • The viewing of content via CytavisionGo is permitted in the Republic of Cyprus and in countries of the European Union where such content is licensed according to the European Regulation (EU) 2017/1128.
  • The use of the CytavisionGo by minors is allowed only with the consent of their parent or guardian.
  • The maximum number of devices that can be linked to the service is five (5).
  • Only one (1) device can be used to view CytavisionGo at any given time.
  • The content and functions of CytavisionGo are regularly updated.
  • The Subscriber agrees not to archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use (except as explicitly authorized in these Terms of Use) content and information contained on or obtained from or through the CytavısıonGo service. Additionally, the Subscriber agrees not to bypass, remove, modify, deactivate, downgrade or suspend any features put in place to protect CytavisionGo content, not to use robots, spider, data export tools or other automated means of accessing CytavisionGo, not to decipher, decompile, disassemble or reverse engineer any of the software or other products or processes capable of providing access to the service, not to incorporate passwords or products and not to alter the content of CytavisionGo in any way or to mine, gather or export data. Furthermore, the Subscriber agrees not to download, publish, send via e-mail or otherwise send or transmit material designed to interrupt, destroy or restrict the functionality of any computer software, telecommunications material or hardware related to the CytavisionGo service, including software viruses or other computer passwords, files or programmes. In case of violation of the present Terms of Use or participation in the illegal or fraudulent use of CytavisionGo, Cyta may disconnect or restrict the use of the service and take all necessary legal measures.
  • The transmission quality of CytavisionGo content is likely to differ from one device to another and may be affected by factors such as the Subscriber’s location, available bandwidth, Internet or mobile network speed and device capability. The Subscriber is responsible for all charges for access to the Internet or the mobile network and should contact his/her provider for information on the likely charges for Internet or mobile network data usage.
  • CytavisionGo enables the viewing of content on devices that support the service’s software. This software, as well as the functionalities and capabilities of the service, may vary depending on the device.
  • The Subscriber agrees to receive automatic software upgrades for CytavisionGo.

4. Username/Password to access CytavisionGo

  • The Subscriber’s username to be used for access to the CytavisionGo shall be the Cytavision service number, as this is stated on the monthly Cytavision bill.
  • The Subscriber must choose a password that provides the maximum security and protects him/her from interception. The password is required in combination with the Subscriber’s username to access CytavisionGo.
  • To control his/her account and avoid allowing others to access it (as it contains information of the account’s viewing history), the Subscriber should monitor all devices that support CytavisionGo and are used to access the service, and never reveal his/her username and password to anyone.
  • The Subscriber is responsible for updating and maintaining the accuracy of all information provided to Cyta.
  • Cyta reserves the right to disconnect or suspend the service to protect the Subscriber, the CytavisionGo service or its partners against any fraudulent activity.

5. Customer support

  • More information about the CytavisionGo app and its functionalities is available on the Cyta website. The Subscriber may also contact the Cyta Call Centre on 132 or email techsupport@cyta.com.cy or enquiries@cyta.com.cy.

6. Termination

  • Cyta may terminate the service at any time without notice in case the Subscriber is in breach of these Terms of Use.

7. Personal Data

  • Cyta will process the Subscriber’s personal data to provide the service and to verify his/her permanent address. This data will be retained throughout the duration of the subscription.
  • Cyta will send the Subscriber account information (e.g. changes to password, confirmation messages, notifications) in electronic form by text message (SMS) or by e-mail to the address provided upon registration with CytavisionGo.

8. Other

  • To complete the registration process, the Subscriber must accept these Terms of Use.
  • Cyta reserves the right to amend these Terms of Use. Any such amendments will be published at: www.ott.cytavision.com.cy.

 

B. Terms of Use: CytavisionGo on a subscription basis via the Internet or the mobile network

1. General

  • The present Terms of Use govern the use of the CytavisionGo service. CytavisionGo is a personalised service provided by Cyta (Cytavision) which enables the viewing of content on the go (movies, TV channels and sports events transmitted via online streaming or a mobile network e.g. the 4G mobile network), on computers or other Android and iOS devices (tablets and smartphones), within or outside the Subscriber’s place of permanent residence in the European Union (EU), in accordance with European Regulation (EU) 2017/1128 on cross-border portability of online content, and provides the capabilities and functions of the CytavisionGo service as described on the website https://www.cyta.com.cy/cytavision-go.
  • To access CytavisionGo, the Subscriber must have a connection to the Internet or the mobile network.

2. Access method

  • CytavisionGo is provided on a subscription basis as a standalone service via the Internet or the mobile network. The content transmitted via CytavisionGo is determined by Cyta, and the Subscriber can be informed about the content at Cyta’s website at: www.cyta.com.cy.
    CytavisionGo allows the Subscriber to view content through its apps available from the App Store and Google Play and from www.ott.cytavision.com.cy. Registration and the creation of a subscription are done via the website www.ott.cytavision.com.cy. To access CytavisionGo, the Subscriber must have a connection to the Internet or the mobile network and a device that supports the CytavisionGo app, and be able to make payments using a credit or debit card.
  • The Subscriber will be able to review the details of the credit or debit card used to pay the monthly subscription for each payment cycle unless he/she cancels the subscription before the next date of payment.

3. Charges and cancellation

  • The subscription charge for CytavisionGo for Subscribers who have chosen to obtain the service via the Internet or the mobile network is charged to their credit or debit card on the day of payment for the next charging period. In some instances, the date of payment may change, such as when a credit card/debit card payment was not completed successfully or if the subscription began on a day which does not occur in another payment calendar month.
  • To register with CytavisionGo on a subscription basis via the Internet or the mobile network, the Subscriber must provide a credit or debit card. If the payment is not completed successfully due to the card’s expiry date, lack of available funds or any other reason and the Subscriber does not terminate his/her account, the access to the service is likely to be cancelled.
  • The Subscriber who has chosen to obtain CytavisionGo as a standalone subscription service via the Internet or the mobile network may cancel his/her subscription or terminate his/her CytavisionGo account at any time. The Subscriber will continue to have access to the service until the end of the charging period.
  • Cyta does not return any charges paid for subscription packages.
  • Cyta may amend the subscription packages and the cost of the service after notifying the Subscriber. Any changes to charges or subscription plans will come into effect in the following payment cycles.

4. Service operation

  • The maximum number of devices that can be linked to the service is three (3).
  • Only one (1) device can be used to view CytavisionGo at any given time.
  • The content and functions of CytavisionGo are regularly updated.
  • The Subscriber agrees not to archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use (except as explicitly authorized in these Terms of Use) content and information contained on or obtained from or through the CytavısıonGo service. Additionally, the Subscriber agrees not to bypass, remove, modify, deactivate, downgrade or suspend any features put in place to protect CytavisionGo content, not to use robots, spiders, data export tools or other automated means of accessing CytavisionGo, not to decipher, decompile, disassemble or reverse engineer any of the software or other products or processes capable of providing access to the service, not to incorporate passwords or products and not to alter the content of CytavisionGo in any way or to mine, gather or export data. Furthermore, the Subscriber agrees not to download, publish, send via e-mail or otherwise send or transmit material designed to interrupt, destroy or restrict the functionality of any computer software, telecommunications material or hardware related to the CytavisionGo service, including software viruses or other computer passwords, files or programmes. 5. Username/Password to access CytavisionGo

  • For the use of the service as a standalone subscription service via the Internet or the mobile network the Subscriber must register to the CytavisionGo, create an account and provide the personal information requested, which include the Subscriber’s full name, the Subscriber’s e-mail address, his/her mobile phone number, his/her residential address and a password.
  • Upon completion of the registration process, a username will be sent to the Subscriber, which, in combination with his/her password, are required to access the Subscriber’s account and the CytavisionGo.
  • The Subscriber must choose a password that provides the maximum security and protects him/her from interception.
  • The Subscriber who has created a CytavisionGo account and whose credit or debit card has been charged has access to and control of his/her account and of all devices that support CytavisionGo and are used to access the service, and is responsible for all account activity. In order to keep control of the account and avoid allowing others to access it (as it contains information of the account’s viewing history), the Subscriber should monitor all devices that support CytavisionGo and are used to access the service, and never reveal his/her username and password or details of the credit card linked to the account to anyone.
  • The Subscriber is responsible for updating and maintaining the accuracy of information provided to Cyta.
  • Cyta reserves the right to disconnect or suspend the service in order to protect the Subscriber, the CytavisionGo service or its partners against any fraudulent activity.

C. Terms of Use: CytavisionGo on a “Pay Per View” basis via the Internet or the mobile network

1. General

  • The present Terms of Use govern the use of the CytavisionGo service. CytavisionGo is a personalised service provided by Cyta (Cytavision) which enables the viewing of content on the go (movies, TV channels and sports events transmitted via online streaming or a mobile network e.g. the 4G mobile network), on computers or other Android and iOS devices (tablets and smartphones), within or outside the Subscriber’s place of permanent residence in the European Union (EU), in accordance with European Regulation (EU) 2017/1128 on cross-border portability of online content, and provides the capabilities and functions of the CytavisionGo service as described on the website https://www.cyta.com.cy/cytavision-go.
  • To access CytavisionGo, the Subscriber must have a connection to the Internet or the mobile network.

2. Available Access methods

  • CytavisionGo is provided as a standalone service to users via the Internet or the mobile network on a Content on Demand basis. The content transmitted via CytavisionGo is determined by Cyta, and the User can be informed about the content at Cyta’s website at: www.cyta.com.cy.
  • CytavisionGo allows users to view content through its apps available from the App Store and Google Play and from www.ott.cytavision.com.cy. The User’s registration and the purchase of content on demand (by credit or debit card) are conducted via the website www.ott.cytavision.com.cy.
  • CytavisionGo enables viewing of a number of live events and other content transmitted live via broadband Internet or the mobile network in the Republic of Cyprus and/or the European Union on a “Pay Per View” basis.
  • The service charge is on a pay per view basis. The User must pay the specific charge with his/her credit or debit card, in order to watch live CytavisionGo content on a “Pay Per View” basis.
  • It is noted that the charge per live event may differ per live event or per access networkand this will be published by Cyta before the purchase of each live event at https://www.cyta.com.cy/tv.

3. Charges and cancellation

  • For the registration of a User to the CytavisoonGo as a standalone service via the Internet or the mobile network on a “Pay Per View” basis, the User must provide a credit or debit card.
  • The User of the CytavisionGo as a standalone service via the Internet or the mobile network on a “Pay Per View” basis has the ability to terminate his/her CytavisionGo account at any time.
  • In case the live event viewing is not possible due to technical restrains attributed to Cyta, Cyta has the discretionary right to decide on possible refunds.
    Cyta may amend the charge for viewing live events on a “Pay Per View” basis after notifying the User.

  • For the use of the service as a standalone subscription service via the Internet or the mobile network on a “Pay Per View” basis the User must register and create an account and provide his/her personal information reguested which include his/her full name, the User’s e-mail address, his/her mobile phone number, his/her residential address and a password.
  • Upon completion of the registration process, the User will be sent a username, which, in combination with his/her password, are required to access the User’s account and the CytavisionGo.
  • The User must choose a password that provides the maximum security and protects him/her from interception.
  • The User who has created a CytavisionGo account and whose credit or debit card has been charged has access to and control of his/her account and of all devices that support CytavisionGo and are used to access the service, and is responsible for all account activity. In order to keep control of the account and avoid allowing others to access it (as it contains information of the account’s viewing history), the User should monitor all devices that support CytavisionGo and are used to access the service, and never reveal his/her username and password or details of the credit card linked to the account to anyone.
  • The User is responsible for updating and maintaining the accuracy of all information provided to Cyta.
  • Cyta reserves the right to disconnect or suspend the service in order to protect the User, the CytavisionGo service or its partners against any fraudulent activity.
